CA Stipulation Filed in Lien-Fee Lawsuit

The lawsuit formulated by a group of service providers who are challenging the constitutionality of the lien-activation fee by Senate Bill 863 have agreed to dismiss Gov. Jerry Brown and Attorney General Kamala Harris from the lawsuit in exchange to keep the lawsuit within the U.S. District Court for the Central District of California.

The plaintiffs have agreed to extend the deadline for answering the complaint until September 12, 2013, and proposed this schedule:

Defendants will answer by Sept. 12.

Attorneys representing the defendants will file a motion to dismiss the lawsuit on Sept. 13.

Plaintiffs will file a response to the motion to dismiss on Oct. 3.

Replies to the brief in opposition to dismiss and a motion for a preliminary injunction to stop collection of the lien-activation fees will be filed on Oct. 17.

Hearing the motion for a preliminary injunction and the motion to dismiss will be held on Oct. 31.
